Insolvency proceedings in Austria

The insolvency database grants access only for a statutorily limited time: one year after the proceedings were terminated (for instance after the final distribution), after the payment period under a restructuring or payment plan has expired, after supervision of a supervised restructuring plan has ended, or after skim-off proceedings have ended, access is no longer granted (section 256(2) IO); if the debtor has performed a confirmed restructuring or payment plan and proves this by documents, access ends earlier on the debtor’s application (section 256(3) IO). The list is therefore a snapshot of the proceedings still accessible, not a record of my entire work as insolvency administrator.

In Austria, claims are lodged with the competent insolvency court, not with the insolvency administrator (section 104(1) IO). The court, the case number and the time limit for lodging claims are shown in the list; further details are set out in the linked edict. In the proceedings listed here I have been appointed insolvency administrator or deputy insolvency administrator; I am therefore unable to represent creditors in these proceedings. For lodging a claim and for representation, please contact one of the privileged creditor protection associations (section 253(3) IO), such as AKV, KSV 1870, ÖVC or ISA, or another attorney. For claims arising from an employment relationship, employees may also be represented to the same extent by their statutory representative body or their trade union (section 253(4) IO).
